MATRIMONIAL ACTIONS
In matrimonial actions, we place a lump sum dollar value on the member’s future annual pension which was accrued during the marriage or cohabitation period under the provisions of a defined benefit pension plan. Note that actuarial valuations of defined contribution pensions are typically not necessary. Our comprehensive reports clearly describe the benefits being valued and provide summaries of the provisions of the plans and the actuarial method and assumptions used in valuing the benefits. We ensure that the reports and calculations are made in accordance with the Canadian Institute of Actuaries’ Standards of Practice. Frequently, we are jointly retained by counsel for both spouses, particularly, where each party has a defined benefit pension. To assist in the information-gathering process, we are pleased to provide our downloadable “Pension Entitlement Questionnaire”. This form would normally be completed by the pension plan administrator. We should also be provided with a copy of the pension plan text or pension booklet in effect as at the date the parties separated. Copies of previous years pension statements are also useful.
